Apple Faces Lawsuit Over “Misleading” iPhone Campaign

A woman is suing Apple over misleading adverts for the tech giant’s latest phone, the iPhone XS and iPhone XS Max.

The issue has come from Apple’s depiction of its “notch” feature in the latest campaign roll out.

The “notch” is a design element of the new iPhones which allows for more space for the phone’s advanced camera and facial ID capabilities.

However, in the recent ad campaign, Apple has blended the “notch” into the screen, a move which has landed them in a potential lawsuit.

Filed with the Northern District of California, the complaint from Courtney Davis and her lawyers argue Davis bought the new iPhone on the basis the phone did not have a “notch” on the top of the screen.

“Images that disguise the missing pixels on the Products’ screens are prominent on the Defendant’s website, as well as in the advertisements of retailers who sell the products,” the complaint said.

“These images were relied on by Plaintiff DAVIS, who believed that the iPhone XS and XS Max would not have a notch at the top of the phone.”

Davis isn’t the first person to pick up on this obscurity, with many taking to social media to voice their complaints.

While the lawsuit may take years to be put in front of a judge, this is the first time Apple has faced complaints about the legalities of its advertising.

Apple is yet to comment on the lawsuit.
