media mogul and mining heavyweight Gina Rinehart is dropping the defamation case against Channel Nine for the mini-series House Of Hancock. But Rinehart’s lawyers said she intends to sue the producers for misleading and deceptive conduct.

Gina Rinehart’s barrister, Sue Chrysanthou, told the NSW Supreme Court they would be taking action against production company Cordell Jigsaw Zapruder under Australian Consumer Law.

Justice Lucy McCallum was told Rinehart intends to sue producers Paul Bennett, Michael Cordell and Claudia Karvan under section 18 of the act, which prohibits a person, in trade or commerce, from engaging in misleading or deceptive conduct.

House of Hancock drew more than two million viewers per episode when it aired on Nine in February. Rinehart claims the series based was riddled with errors.

“As a show it has denigrated the memory of her late father and attempted to depict highly personal events in a fictionalised and dramatised way while maintaining that it is a ‘true’ story,” Hancock Prospecting executive director Tad Watroba told The Australian.

“The mini-series does not portray Mr Lang Hancock, Mrs Hope Hancock, Mr and Mrs Rinehart, or their deep and genuine feelings for each other. (It) is based on scenes which either didn’t occur, or the very very few that had some slight basis being so distorted as being untruthful portrayals.”
